1. Educational Purpose Only

Chartdaddy is a purely educational learning platform for studying the ICT methodology and price-action concepts. All output — including any bias, signal, entry, stop, target, confidence score, watch-list, or reasoning — is intended solely for learning and practice. Chartdaddy does not provide financial, investment, tax, legal, brokerage, or trading advice, is not a fiduciary, and is not registered as an investment adviser, broker-dealer, commodity trading advisor, futures commission merchant, or financial institution with the SEC, CFTC, FINRA, NFA, or any other regulatory body.

2. Not Trading Advice · Assumption of Risk

You agree that you will not rely on any Chartdaddy output to place real trades or make financial decisions. Trading and speculating in stocks, futures, options, forex, cryptocurrencies, or any other financial instrument involves substantial risk of loss, including the total loss of capital, and is not suitable for every person. Past performance is not indicative of future results. Hypothetical or simulated results have inherent limitations. You alone are responsible for your financial decisions and any resulting gains or losses.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract to use Chartdaddy. You represent that your use of Chartdaddy does not violate any law, regulation, or third-party right applicable to you.

4. Disclaimer of Warranties

Chartdaddy is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted service. We do not warrant that the service will be error-free, secure, timely, or that any output is accurate, complete, or suitable for any purpose. AI models can and do produce incorrect, misleading, or fabricated output.

5. Limitation of Liability

To the maximum extent permitted by law, Chartdaddy and its owners, operators, affiliates, employees, contractors, licensors, and suppliers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages — including lost profits, lost data, lost opportunity, trading losses, or business interruption — arising out of or in connection with your use of or inability to use the service, even if advised of the possibility of such damages. Total aggregate liability for any and all claims shall not exceed the greater of (a) the amount you paid Chartdaddy in the 30 days preceding the event giving rise to the claim, or (b) USD $50.

6. Indemnification

You agree to defend, indemnify, and hold harmless Chartdaddy and its owners, operators, affiliates, employees, and contractors from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the service; (b) your trading, investment, or financial decisions; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

7. Subscriptions & Billing

Monthly plans automatically rebill every 30 days at the then-current price until canceled. You authorize Chartdaddy and its payment processor (Stripe) to charge your payment method on file for each billing cycle. You may cancel at any time from your Settings page; cancellation stops future rebills but does not remove credits already granted and does not refund the current or any prior billing period. Credit packs are one-time purchases and are consumed as you use them. Unused credits do not carry monetary value and cannot be exchanged for cash.

8. Acceptable Use

You will not: (a) resell, redistribute, sublicense, scrape, or reverse-engineer the service or its output; (b) use the service to build a competing product; (c) create multiple accounts to circumvent free-credit limits, billing, rate limits, or enforcement actions; (d) upload unlawful, infringing, or harmful content; (e) attempt to bypass authentication, security, or usage controls; or (f) use the service in any manner that violates applicable law or the rights of others.

9. Accounts & Data

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Study results are stored in your personal journal for 7 days and then automatically deleted. Chartdaddy may retain minimal metadata (billing records, security logs) as required by law or legitimate business need.

10. Intellectual Property

Chartdaddy, the Chartdaddy name and logo, the underlying software, and all associated content (excluding user-uploaded charts) are owned by Chartdaddy or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You are granted a limited, revocable, non-transferable, non-exclusive license to access the service for personal, educational, non-commercial use only.

11. User Content License

You retain ownership of charts and materials you upload. You grant Chartdaddy a worldwide, royalty-free, non-exclusive license to process, transmit, and store your uploads solely for the purpose of operating and improving the service. You represent that you have all necessary rights to upload the content you submit.

12. Third-Party Services

Chartdaddy relies on third-party providers (including Stripe for payments, Supabase for data storage, and AI model providers for output generation). Chartdaddy is not responsible for the availability, accuracy, or actions of these third parties. Their terms and privacy policies apply to your interactions with them.

13. AI Output

The service uses artificial intelligence to interpret uploaded charts. AI output may be incorrect, incomplete, biased, or fabricated. You acknowledge these limitations and agree not to rely on any AI output for real trading, investment, or financial decisions.

14. Termination

Chartdaddy may suspend, disable, or terminate your access at any time, with or without notice, for any reason including violation of these Terms, with no refund of any prepaid amounts (see the No Refunds section above). You may stop using the service at any time. Sections that by their nature should survive termination (including No Refunds, Disclaimer, Limitation of Liability, Indemnification, Governing Law, and Arbitration) survive.

15. Governing Law & Arbitration

These Terms are governed by the laws of the United States and the state in which Chartdaddy operates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively through final and binding individual arbitration administered under the rules of a recognized arbitration provider, and not in court. You and Chartdaddy each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. If arbitration is unavailable, exclusive jurisdiction and venue shall lie in the state and federal courts located in Chartdaddy's operating jurisdiction.

16. Force Majeure

Chartdaddy is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government action, internet or infrastructure outages, or failures of third-party providers.

17. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with any acknowledgments accepted at purchase, constitute the entire agreement between you and Chartdaddy regarding the service and supersede any prior agreements.

18. Changes

These Terms may be updated from time to time. Material changes will be reflected by an updated “Last updated” date. Continued use after an update constitutes acceptance of the revised Terms.
